Michigan is a no-fault divorce state, meaning the party seeking a divorce does not need to prove fault before a divorce is granted. However, the fault may be considered by the court in determining the distribution of assets, spousal support, and division of property.
Child Custody and Visitation
In Michigan, legal custody is the parent’s right to make major decisions regarding the child. Physical custody is where the child lives. If parents are unable to agree on the custody of a minor child, the court will intervene and decide the custody of the child based on the best interests of the child. In addition to determining custody, the court will decide the parenting time (visitation) each parent will have with the child.
Once the court’s decision is made regarding custody or support, it can be difficult to change. To apply for a modification, an individual must show that circumstances have changed and require new arrangements.
Division of property
Michigan is not a common property state. This means that all property must be divided equitably. This does not mean equally, but the court will attempt to reach a fair division of property including money, real estate and any other assets like investments.
Division of marital debt
Similarly to property, debt must be divided as part of a divorce. This can mean consumer debt such as credit cards, educational debt in the form of student loans or mortgages.
